Flakon allows customers to rate the products we offer and post reviews on its website using forms provided by our partner platforms (Judge.me, TrustPilot, Google Reviews…)

Posting a review on a product description page requires the website user to accept and comply with these terms of use beforehand.

Our approach

The main purpose of allowing reviews on www.flakon.fr is to give website users a space to share their views and contribute their experiences of products they have bought and know. This enables them to express their opinions freely and inform the website’s shoppers in a fair and constructive spirit.

The aim is therefore to bring the different views to light, respect them and enable website users to form their own opinions.

Submitting reviews

There are two ways to leave comments on the website:

A ‘verified purchase’ review: a review requested by Flakon through a form provided by a specialist customer review collection service such as TrustPilot or Judge.me, sent by email following a purchase on our website.

An unverified review: a review submitted directly on our website, flakon.fr, via the ‘Reviews’ page, or indirectly on Flakon’s review pages elsewhere online (Judge.Me, TrustPilot, Google…)

Both verified and unverified reviews are then moderated according to the rules set out below. 

Customers submitting a review must meet the following conditions: they must be individuals, have no conflict of interest and have personally used the product they are reviewing.

In addition, reviews must:

• Not be defamatory, insulting, obscene, offensive, violent or incite violence; not be political, racist or xenophobic; and, more generally, not contravene applicable laws and regulations, individual rights or standards of decency;
• Not refer to or mention reviews by other website users;
• Not disclose all or part of the premium online content;
• Not be used for personal or professional purposes, particularly advertising;
• Not contain personal data;

Flakon reserves the right to contact the review’s author to verify it if there is any doubt about its authenticity.

After moderation, ‘verified purchase’ reviews are displayed on product description pages, in the ‘Customer reviews’ tab and on the main ‘Reviews’ page. Unverified reviews are displayed only on the main ‘Reviews’ page.

Flakon provides no compensation in exchange for submitting a review, except for possible future, time-limited promotional codes offered as an incentive to include photographs supporting the authenticity of posted reviews. Furthermore, a review’s author will never be asked to provide compensation of any kind, financial or otherwise, in exchange for amending or deleting their review.

Review sorting

By default, reviews are sorted to highlight product photos and help consumers form an accurate impression of what they will receive. Reviews can also be sorted in other ways, such as newest first, highest rated first, lowest rated first, most helpful (that is, by popularity), or videos first.

Publication and retention periods

All reviews are published immediately, whether positive or negative.

Through its partner, Flakon undertakes not to retain indefinitely the personal data of consumers who submit customer reviews using the available services. 

To this end, Flakon anonymises customer reviews through its partner by displaying only the reviewers’ first names and initials.

Moderation

Comments and reviews are moderated. 

Moderation is a process carried out after a review is published to ensure that the content collected complies with French law. 

Review partners such as Judge.me therefore undertake, in particular, to comply with these regulations and the AFNOR NF Z74-501 standard, as well as the terms of use available on their website.

Moderation checks this compliance to determine whether to retain or remove the content.

Accordingly, Flakon reserves the right to remove at any time comments or reviews that include personal information about the author or any third party; contain insulting or defamatory statements about the author or any other individual or legal entity; or are otherwise unlawful, including statements that are defamatory, violent, racist or paedophilic, call for murder or suicide, or incite hatred or discrimination. Sellers’ comments must not infringe copyright or any third-party rights.

Reviews may also be refused publication for the following reasons:

• The rating does not match the comment.
• The text contains random characters or is so poorly written that it is unintelligible.
• The product characteristics have not been described.
• The content is unrelated to the product being reviewed.
• The text contains personal information or any other information that could lead to identity theft: the surname or first name of individuals who are not public figures, a telephone number, a precise physical address or email address, a credit card, social security or bank account number, or any other information that could lead to identity theft.
• The text encourages purchases from a competitor.
• The text indicates that the user has not yet tried the product.
• The content contains insults or profanity.
• The review’s attributes contain concrete indications of a conflict of interest.
• A user posts an inappropriate comment about other content or its author.
• The text is clearly spam or mentions websites or URLs, including those of the customer or manufacturer.
• The text calls for legal action.
• Customer service has intervened to resolve the dispute, and the customer is invited to update their review.
• The consumer has contacted the review administrator to delete or amend their review.
• The review administrator considers that they could incur civil or criminal liability.

If a review is removed following moderation, the customer who submitted it may, where possible, be informed that their review was rejected and why. 

Permission to use content

The website user authorises Flakon, free of charge, to use their comments and any other content they have created (text, photos and videos) in connection with the marketing and promotion of the product concerned, including through the following channels:

• On the internet, including across all Flakon corporate, commercial or community websites, blogs and/or pages, and on the websites, blogs or pages of partners or affiliates, as well as on search engines, particularly those displaying reviews and comments;
• For Flakon’s internal and corporate communications and journalistic reporting;
• On all printed materials, including publications, catalogues, press, leaflets, flyers and point-of-sale displays.
• In organic and/or paid social media posts (Facebook, Instagram, TikTok, etc.)

For the purposes defined above, the rights of use automatically granted when a review is published include the following:

• Under the right of reproduction, the right, directly or through a third party, to reproduce or have reproduced, circulate and make any copy or duplicate, without limitation on the number of copies, in whole or in part, free of charge or for payment, on any paper, computer, electronic, audio, optical or other present or future medium, by any present or future means.
• Under the right of public presentation, the right, directly or through a third party, to present or have presented publicly, in full or in extracts, in whole or in part, free of charge or for payment, by any means, including on-screen presentation, or by any other means in any public or private place.
• Under the right of broadcasting, the right, directly or through a third party, free of charge or for payment, to broadcast by terrestrial transmission, satellite, television, cable operator or any other present or future means of telecommunication. This right also includes distribution on internal networks and on networks intended for an audience not belonging to a single legal entity, such as the Télétel network and the internet.
• Under derivative rights, the right, directly or through a third party, free of charge or for payment, to use, adapt, arrange, modify and translate, or have used, adapted, arranged, modified and translated, all or part of the content.

Personal data

The website user agrees that, when comments are published, certain personal information about them may appear: their first name, the first letter of their surname and their town or city of residence. 

Website users’ comments and personal data are collected and processed electronically to manage and publish comments. 

In this context, the data collected may be transferred to a service provider for the purpose of managing the comment management tool. 

In accordance with the French Data Protection Act of 6 January 1978, as amended by Act No. 2018-493 of 20 June 2018, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), website users have the right to access and rectify their personal data and to object to its processing by emailing hello@flakon.fr.
